1 The plaintiff in error, Mike Micklick, hereinafter referred to as defendant, was tried and convicted in the county court of Pittsburg County for the offense of unlawful possession of intoxicating liquor with the intent to sell. A jury was waived and the case tried before the court, who found the defendant guilty as charged, and assessed punishment at 90 days in the county jail, and a fine of $200 and costs.
