Defendants appeal by leave granted. The State of Michigan and the Michigan Department of Treasury, hereinafter referred to as defendants, hereby appeal from a judgment of the Court of Claims entered June 2, 1973, in favor of Michigan Wisconsin Pipe Line Company, a Delaware corporation, hereinafter referred to as claimant. By such judgment, the state was ordered to refund certain use taxes paid in the amount of $23,985.80 plus interest, which taxes had been levied upon the natural gas used by claimant as fuel in the operation of its compressor engines.
