On the trial of the above entitled action brought by John S. Mickoleski against the defendant, Henry Becker, to recover damages sustained by plaintiff as the result of being unlawfully assaulted and beaten by defendant, the jury found in a special verdict that the assault was wanton, wilful and unprovoked, and that by reason thereof the plaintiffs actual damages were $5,589.15 and his punitory damages were $2,680. Upon the denial of defendants motions after verdict the court ordered judgment thereon for plaintiffs recovery from defendant of the damages assessed by the jury, and judgment to that effect was entered on July 10, 1947. On August 7, 1947, defendant noticed an appeal from that judgment, but before the transmittal of the record on that appeal defendant on August 14, 1947, noticed a motion in the circuit court for a new trial on the ground of alleged new evidence discovered since the trial in June 1947. Upon the hearing of this motion on affidavits presented by each of the parties in support of their respective contentions, the court on September 17, 1947, entered an order granting defendants motion for a new trial on the ground of the alleged newly discovered evidence; and setting aside and vacating on that ground the judgment entered on July 10, 1947. Plaintiff appealed from that order.
